Terms & Conditions

1. Order processing:

When ordering a commissioned artwork, you will be notified of an estimated completion date before payment. Please note although highly unlikely, completion time of portrait(s) may take longer than the estimated date as each artwork is a process that I do not wish to rush.

Original artwork & print sales will be processed & shipped within 2-5 working days.

2. Packaging:

Artworks & prints are packaged flat to ensure flatness of the paper. Artworks will be protected with glassine paper, placed in either an archival plastic sleeve or wrapped in acid-free tissue paper. This is then padded with either foam board and/or cardboard to ensure a safe transit. I aim to make my packaging as recyclable & eco friendly as possible while still protecting your artwork during transit.

Presentation gift packaging for commissions is available at an extra cost.

3. Payment:

Payments are securely made through my website’s checkout via PayPal (https://www.paypal.com/uk/webapps/mpp/ua/legalhub-full). If you do not have a PayPal account, you are able continue to safely checkout via PayPal as a guest where you are able to enter in your card details.

Commissions: Once we have selected a reference photo for the project, I will send you the 1st custom link to pay for the initial 50% cost of the portrait via my website’s checkout to begin the process. Upon completion & once you have approved of the final result, I will send you the 2nd custom link to pay for the remaining 50% cost of the portrait + the shipping cost via my website’s checkout.

4. Shipping:

All orders are shipped from the UK.

Commissions: UK shipping is £10, international shipping is via UPS & ranges from £15-£50 depending on size & location. Each portrait is sent with tracking info and may require a signature upon delivery.

Prints: UK shipping is £5-10, international shipping is via UPS & ranges from £10-£40 depending on size & location. Each print is sent with tracking info.

5. Address & delivery:

All orders larger than 30x40cm within the UK and all orders of any size internationally are sent via UPS. For this, you must supply me with your mobile phone number as they require it for recipients.

Please make sure to double check the given delivery address before purchasing. If you notice it is incorrect, please email me ASAP with the correction (shaymusart@gmail.com). If the items has already been sent with the incorrect address then I will not be able to alter it to the correct address.

If the artwork was sent but unclaimed and then returned to me, I am happy to re-send the artwork however the buyer will have to front the cost of shipping it again.

Please contact me immediately at shaymusart@gmail.com if the artwork(s) have arrived damaged or if you have not received it 2 weeks after the estimated delivery date.

6. Returns & refunds:

First payment: If the first payment has been made and no sketch has been started, I will offer a full refund. If I have started / completed the sketch, I will offer you a refund worth the amount you paid minus £50.00, this is due to the paper becoming unusable for other projects once the composition sketch has been drawn on, plus the time spent on it.

Second & final payment: This is to be paid upon completion of the artwork once it’s to your satisfaction. Your completed portrait will only be shipped to you once the agreed full amount including shipping costs has been paid. If this is not paid, your portrait will not be shipped to you.

Originals, Prints & Other:

If you are unhappy with your purchase and seek a refund, a full refund may be processed, but only once the item is shipped back and received undamaged. Cost of return shipping is at the buyer’s expense. In the unfortunate and highly unlikely case of a damaged product, please contact me immediately to see if resolutions can be made.

7. Liabilities:

For purchases made from outside of the UK, any additional custom & tax fees that may occur when the package reaches your country are the responsibility of the buyer. These charges will vary depending on where you are located. I shall not be responsible for any of these fees.

8. Prices:

I reserve the right to determine the prices for any of my art products. Product prices and shipping costs are subject to change at any time. If you have already placed your deposit for a commission, an increase or decrease in price will not effect your original quoted cost.

9. Artwork accuracy:

As a result of having different screens across devices, the colours may vary of the artwork or prints to how you view it on your own device.

For pastel artworks that have a colour background, portraits come with a blank border a few millimetres thick on each side where the paper was taped to my desk, this also makes it possible to pick the drawing up without disturbing / touching any of the pastel itself. Please keep in mind that this will very slightly reduce the portrait size when coming to choose a picture mount for your frame. Professional framers should be able to factor this in.

Mounted option may be available for your portrait commission. If you select this option, expect the aperture of the mount to be slightly less than your portrait size. This is to hold the drawing firmly in place but it also means that the drawing area will be slightly covered / reduced in size.

Due to the nature of original pastel artwork, there may be slight visible blemishes on the paper – all measures are taken to reduce this as much as possible.

Actual paper sizes may be slightly larger or smaller than the chosen size on any side due to having to custom cut the paper from large sheets.

10. Changes to completed commission:

Once the final touches to your commissioned artwork are being made, you will receive a high quality photo to confirm your satisfaction. If you wish to have any details or aspects of the artwork changed, I am more than happy to do so within reason. If you require a significant change, this will incur an extra charge. Please note that I may not be able to make some significant changes once the artwork is completed due to the nature of the materials.

11. Framing:

I currently do not offer framing options, artworks will arrived unframed.

12. Commission video recordings:

Commissions may be video recorded for the client if they wish to watch the process of the drawing come to life. This may be requested via the commission submission or via email. A video recording of the process may be in the form of a 90 second or less snippet reel (portrait orientation), or a select number of minuets time-lapse uploaded to my YouTube channel (landscape orientation). Reels are often posted on my social media or website.

In some cases, I may also ask permission to upload the real-time footage & reference photo to my paid subscription Patreon channel for my art students to learn from, this will be asked via email during the beginning commissioning stage. I will always ask your permission beforehand and only upload to my Patreon channel with your permission.

The reel, time-lapse or real-time footage videos are not guaranteed in case of unforeseen complications or disruptions during the creation process. They are not included with the purchase but are rather considered as a bonus to the purchased physical commissioned drawing.

I retain the copyright for all commissioned artwork. I also retain the copyright for any prints of commissioned atworks. No commissioned artworks may be reproduced, altered or copied without my written permission. I will never recreate or reproduce a clients personal commission for anyone else unless given permission by the client. I reserve the right to share commissioned artworks for self promotional purposes.

The copyright for any of my non-commissioned artworks remain with me and I alone reserve the right to reproduce those images. Those who purchase any of my non-commissioned artwork do not have any rights to reproduce the image unless I also sell the copyright to them. I reserve the right to use my artwork for promotional purposes online and in other promotional areas.

If you have requested & given me permission to create a time-lapse and/or real-time video of your commission, I will solely retain the copyrights to these video(s). I also retain the right to solely upload, distribute and monetise these videos.

14. Final provisions:
  • By ordering any of these products, you agree to be bound by these terms & conditions.
  • By placing an order, you warrant that you are at least 18 years old or have parents’ permission.
  • Shipping costs and payment fees are recognised before purchase.
  • Time-lapse & real-time videos of commissions are not guaranteed or included in the purchase, they are bonus’ to the physical artwork.
  • All custom taxes are a responsibility of the customer.
  • Commissions may be recorded, documented and posted on my website & social media sites.
  • These terms and conditions are subject to change at any time.
